Warranty & Performance

These Warranty Terms apply to Equipment manufactured and sold by EMIT Technologies, Inc. ("EMIT") to the purchaser identified in the applicable Equipment Purchase and Commissioning Agreement ("Customer"). Warranty coverage is limited to Equipment operated in accordance with EMIT's documentation, within design parameters, and by qualified personnel.
Controls & Electronics Warranty
Controls, electronic modules, instrumentation, and associated electrical components supplied by EMIT Technologies, Inc., including:
- DCiris panel controllers
- DCbrain control modules
- DCbrain+ control modules
- DCcortex physics-based digital twin
- DCrelay telematics devices
- DCstation station controllers
…and their successor models as identified in EMIT's then-current product documentation, are warranted for a period of twenty-four (24) months from the ship date against defects in materials and workmanship. EMIT will, at its option, repair or replace defective components at no charge to Customer.
This warranty excludes:
- Damage from improper installation not performed or supervised by EMIT field services
- Physical abuse, impact damage, or vandalism
- Water intrusion or flooding beyond the enclosure's rated protection class
- Power surges, voltage spikes, or inadequate grounding
- Sensor contamination due to process fluid intrusion or incompatible materials
Structural Components Warranty
Equipment housings, frames, welded assemblies, structural enclosures, platforms, and staircases fabricated by EMIT Technologies, Inc. are warranted against defects in materials and workmanship for a period of thirty-six (36) months from the ship date.
This warranty does not cover:
- Corrosion resulting from exposure to corrosive chemicals, salt environments, or atmospheric conditions beyond normal outdoor industrial exposure
- Thermal shock damage from extreme temperature cycling outside design parameters
- Vibration cracking caused by operation outside specified vibration limits
- Cosmetic degradation (surface coating wear, minor scratches, discoloration) that does not affect structural function
- Damage caused by modification, field welding, or drilling not authorized by EMIT
Catalyst Performance Warranty
SCR catalyst assemblies, AFRC systems, and associated emissions control components supplied by EMIT Technologies, Inc. are warranted for:
- Twenty-four (24) months from the ship date, or
- Sixteen thousand (16,000) operating hours,
whichever occurs first.
Coverage includes catalyst substrate integrity and rated NOx reduction performance capability under specified operating conditions. All of the following must be maintained throughout the coverage period:
- Fuel gas within quality specifications: heating value ≤ 1,400 BTU/SCF; H₂S, chlorides, and siloxanes within EMIT-specified limits
- Exhaust temperature within the specified operating range for the catalyst type
- Lubrication oil within specified grade and contamination limits
- DEF (urea solution) meeting ISO 22241 standard with concentration between 31.8% and 33.2% urea by weight
- Catalyst washing (where applicable) performed per EMIT's maintenance schedule
This warranty does not guarantee regulatory compliance under all field operating conditions; coverage applies to catalyst performance capability, not permit compliance outcomes. Additional exclusions include:
- Performance degradation due to operation outside specified fuel quality, temperature, or DEF parameters
- Physical damage from foreign object ingestion
Oxidation Catalyst Operating Requirements
Catalyst performance using an EMIT air/fuel ratio controller depends upon properly defined set-points, engine tuning, operating conditions, and fuel gas composition. Air/fuel ratio controller performance is guaranteed for fuel gas with HHV content up to 1,400 BTU/SCF unless otherwise specified.
The oxidation catalyst performance warranty does not cover:
- Excessive ash masking caused by low-load operation
- Improper engine maintenance
- Inappropriate lubrication oil
- Continuous engine misfire
- Excessive exhaust temperatures
- Catalyst poisoning or contamination
Unless otherwise stated:
- Minimum converter inlet temperature: 700°F
- Maximum converter inlet temperature: 1,150°F
If a high-temperature shutdown switch is not installed, thermal deactivation above 1,300°F is not covered. Catalyst conversion efficiencies apply to engine loads between 50% and 100%.
Engine lubrication oil requirements:
- Ash content less than 0.6% by weight
- Maximum oil consumption: 0.01 gal/bhp-hr
- Maximum catalyst ash loading: 350 g/m³
- Phosphorous and zinc additives limited to 0.03% by weight
SCR System Warranty & Operating Requirements
SCR catalyst performance depends upon:
- Proper engine tuning
- Exhaust temperature management
- DEF quality
- Proper DEF dosing operation
- NOx sensor calibration
- Operation within specified design conditions
Diesel Exhaust Fluid (DEF) must meet ISO 22241 standards with urea concentration between 31.8% and 33.2% by weight.
The SCR warranty does not cover failures or degradation caused by:
- Contaminated or improper DEF
- Improper DEF storage or handling
- DEF crystallization
- Sulfur contamination
- Oil fouling
- Ammonia salt deposits
- Water intrusion
- Thermal shock or thermal runaway
- Excessive exhaust temperatures
- Engine-out NOx levels exceeding system design basis
- Catalyst poisoning agents
Known catalyst poisoning agents include, but are not limited to: iron, nickel, sodium, chromium, arsenic, zinc, lead, phosphorous, silicon, potassium, magnesium, copper, tin, and mercury. Total poison concentrations in the exhaust stream are limited to 0.3 ppm unless otherwise specified.
Universal Exclusions
The following exclusions apply across all product categories:
- Misuse and improper operation. Damage or failure resulting from operation outside design parameters, failure to follow EMIT's installation and operating documentation, or use for purposes other than the intended application.
- Unauthorized modifications. Any modification, repair, or alteration made by anyone other than EMIT personnel or EMIT-authorized service providers, without EMIT's prior written approval.
- Third-party causes. Damage caused by third-party equipment, software, services, or fuel/process streams not provided or specified by EMIT.
- Consumable components. Components that wear through normal use, including but not limited to seals, gaskets, filters, DEF nozzles, and sensor electrodes.
- Force majeure. Damage resulting from events beyond EMIT's or Customer's reasonable control, including natural disasters, floods, lightning, acts of war or terrorism, or grid failures.
EMIT disclaims all liability for indirect, incidental, consequential, special, or punitive damages arising from any warranty claim, including loss of production, lost profits, or regulatory penalties, regardless of cause or theory of liability.
Warranty Claim Procedure
Notice. To initiate a warranty claim, Customer must notify EMIT in writing (email to warranty@emittechnologies.com is acceptable) before the end of the applicable coverage period. The notice must describe the defect or failure in reasonable detail, including the date first observed, operating conditions at the time, and the equipment serial number.
Investigation. EMIT may require remote diagnostics access, a site visit, or return of the defective component for evaluation before determining coverage. EMIT will respond to warranty claims within five (5) business days of receipt.
Remedy. If EMIT determines the claim is covered, EMIT will, at its sole option, repair or replace the defective component. Coverage includes EMIT-paid labor for field repair or replacement.
Shipping. For components returned to EMIT: Customer pays outbound shipping; EMIT pays return shipping of repaired or replacement components.
Non-covered claims. If EMIT determines that a claim is not covered, EMIT will notify Customer in writing before performing any chargeable repair. Customer must authorize the repair before EMIT proceeds.
Disclaimer & Exclusive Remedy
The warranties set forth herein are EMIT's sole and exclusive warranties for Equipment. EMIT expressly disclaims all other warranties, express or implied, including any implied warranty of merchantability, fitness for a particular purpose, or non-infringement. Customer's sole remedy for a covered warranty claim is repair or replacement of the defective component as provided herein.
Governing Terms
These Warranty Terms are incorporated into and governed by the Equipment Purchase and Commissioning Agreement between EMIT and Customer. In the event of conflict, these Warranty Terms govern with respect to warranty coverage and remedies.
The version of these Warranty Terms identified in Attachment A to the applicable Equipment Purchase and Commissioning Agreement governs each order; subsequent updates to these Warranty Terms do not affect orders placed under a prior version.
